Chandigarh Consumer Court has clarified during the hearing of a case that the policy/terms and conditions at the time of purchase of movie tickets should remain in force till the time the ticket is used. The subsequent change cannot be applied to reject the demand for cancellation of the ticket. The court made this observation on the complaint of Ravi Inder Singh of Sector 33. The complaint was filed in the consumer court, making Big Tree Entertainment Pvt Ltd (Book My Show) and PVR Cinemas at Elante Mall a party in the case.
Bala movie tickets were booked
On December 3, 2019, the complainant had booked two tickets for Bala movie for December 5 through BookMyShow’s app. For this he had paid Rs 636.72. Due to the ill health of the complainant’s daughter, on 5th, she demanded cancellation of the ticket and met the customer care of BookMyShow. He was told that he could have got the ticket canceled not 20 minutes before the start of the show but 2 hours before. At the same time, according to the complainant, it was told to cancel it (transaction) 20 minutes before on the ticket. However, his demand was rejected nonetheless. The complaint was filed terming it as lapse in service and involvement in wrongful business activities. According to Accountable Book My Show, the cancellation policy was changed.
Court’s comment in the matter
The court observed that it was clear on the ticket that under the superstar policy, the transaction could have been canceled 20 minutes earlier. Thus, the respondent was found guilty of dereliction of service. In such a situation, both these defendants have been fined Rs. During the hearing, PVR Cinemas was declared ex-party in the case.
